The hirer will abide by the following terms and conditions during the course of their possession of the plant/equipment. If the hirer is in default of any of their obligations under this agreement or does anything whatsoever which in the view of Parish Plant would or might have the effect of jeopardising their property, we may forthwith terminate the agreement. Any termination of the agreement shall be without any prejudice to any right of Parish Plant in respect of the agreement committed by the Hirer prior to the date of such termination. Parish Plant reserve the right to retake possession of the plant/equipment wherever located, and at any time.

If during the period of the hire, the customer becomes apparently insolvent or seeks or attempts to seek relief under statute for the relief of insolvent debtors, the plant/equipment shall remain the property of Parish Plant, and the hirer shall have no right to the vehicle.

The Hirer agrees to:

  1. Keep the plant/equipment in good condition. Observe and check regularly all oil, water and antifreeze levels.

  2. Be responsible for the cost of all fuel, oil and other consumables during the hire period. Parish Plant will not reimburse excess fuel.

  3. Be responsible for all repairs to plant/equipment whilst on site, caused through incorrect usage of plant/equipment.

  4. Ensure that the vehicle is always stored off street in a safe location and that all reasonable steps are taken to prevent damage or loss to the plant/equipment.

  5. Pay Parish Plant for any damage or missing items, or cleaning costs incurred in respect of putting the plant/equipment back into a fair and reasonable condition at the end of the hire period.

  6. Ensure that adequate public liability insurance is held to cover accidental misuse damage causing by plant/equipment. Ensure that adequate insurance is in place for full replacement cost of plant/equipment at manufacturer’s current retail price.

  7. Pay all expenses, excess charges and legal costs incurred by Parish Plant in enforcing the terms and conditions of this agreement or in the event of an insurance claim being made as a result of damage to the plant/equipment.

  8. Parish Plant will not be liable for any damage to, or repair of any mains services or structures caused by use or misuse of plant/equipment, by the hirer.

  9. Ensure that all users of the plant/equipment are suitably qualified professionals.

  10. Not attempt to sell, pledge assign, encumber or otherwise dispose of the vehicle or attempt to do so.

  11. The signed agreement commences at the date and time shown and terminates at the date and time shown on the signed agreement.

If the agreement is signed on behalf of a Company, Firm, Trust or Unincorporated Association, it is deemed that the person signing this agreement has actual authority to do so and that the body concerned will be bound by and observe and perform all the terms and conditions of this agreement.

Any deposit paid to Parish Plant will be refunded in full to the hirer or may be used as payment or part payment for any costs or charge incurred by Parish Plant under the terms and conditions of this agreement.
